Sirs: In connection with several incidents which have occurred in China during recent months involving relations between the Government of the United States and another government, the Department of State has recently informed the Embassy that in cases in which it is clear that American responsibility exists it would appear appropriate, as well as helpful in reaching a prompt and satisfactory settlement, for the Consular Officer in charge, when such cases arise, to call on the representative of the foreign government concerned for the purpose of giving assurance that an adequate and prompt investigation would be made, and also to express regret if, in the judgment of the officer concerned, the facts then known warrant such action. If doubt exists on the last-named point, the instructions of the Embassy should immediately be requested.

The Department of State also considers that cases involving an infraction of the personal or property rights of foreigners in which American citizens are in any way involved should be promptly reported to the Embassy, with all the facts and pertinent comment, whether or not the cases are likely to become diplomatic issues.

The above is communicated to you for your information and future guidance in cases which may complicate the relations between the United States and another country.
