Your 34, May 29, 5 p.m. The Department does not consider that the resolution proclaimed by the President on May 28 contravenes Article VI of the Treaty of 1858 or the terms of the Habana Convention. The resolution prohibits the sale of arms and munitions of war in the United States to those countries now engaged in armed conflict in the Chaco. Regarding the retroactive effect of the resolution, neither this Department nor the Executive will rule on the sale of arms or munitions made prior to or subsequent to the date of the resolution. This is a matter for determination of the courts.
