The Secretary of State to the British Chargé (Chilton)

Sir: With further reference to your note of December 29, 1923, in regard to the legal proceedings instituted by the Government of the United States against the Sanitary District of Chicago to prevent the unauthorized diversion of water from Lake Michigan, I have the honor to inform you that the Department has been advised by the Solicitor General of the United States that an appeal has been taken by the Sanitary District of Chicago from the decision of the [Page 352] United States District Court in favor of the Government and that the appeal is still pending in the Supreme Court of the United States. The Solicitor General further stated that as soon as the record of the case shall have been printed a motion will be submitted to the court to advance the case for early argument.
